The defendants were involved in an illegal asbestos removal project at the Mohawk Furniture, Inc. in Broadalbin, New York. The Asbestos Control Bureau disclosed that no asbestos project notification was file with the State of New York by anyone concerning asbestos abatement at this facility, as is required by law.

Rolla was sentenced to 60 months probation and ordered to pay a $100 special assessment fee, a $40,000 federal fine and restitution in the amount of $2.5 million to the U.S. EPA for clean up costs.

The defendant is the owner of the Hilton Industrial Park in Rensselaer, New York. He hired workers to illegally handle asbestos from buildings which he owned. The defendant admitted that the workers illegally disposed of the asbestos by dumping it at various locations near the New York/Massachusetts border. Illegally dumping asbestos can cause asbestos fibers to become airborne and inhaling asbestos fibers is a known cause of lung cancer, a lung disease known as "asbestosis" and mesothelioma which is a cancer of the chest and abdominal cavities. This case was prosecuted by the U.S. Attorney's office in Syracuse.
